ADSL Terms & Conditions

I/We agree to be bound by the following Terms & Conditions:

DragNet Standard Terms and Conditions: as outlined on the DragNet website www.dragnet.com.au. Please read them or ask for printed or alternative electronic version before signing this agreement.

AND

Special DragNet ADSL Terms & Conditions:

  1. General ADSL

a) The Setup Fee may include the cost of modem/routers. It does not cover the cost of labour for assistance (onsite or offsite):

a. $119 setup fee does not include any modem/router.
b. $199 setup fee includes the cost of a basic modem/router.
c. $249 Setup Fee includes the cost of a wireless modem/router.


b) DragNet cannot be held responsible for any delays in the provisioning of any requested ADSL services.
c) Unused data/download is not cumulative from month to month and is not redeemable in any way.
d) This application form is subject to change without notice, new revisions or version of this application form supersede all prior versions.
e) Any change of plan type either up or down will incur a once off Fee of $45.00 billed to your account on the day of the change occurring.
f) Changes of ADSL plan may take up to 7 working days to complete and DragNet cannot be held responsible for delays in provisioning the requested changes.
g) Customers on fixed term plans are unable to change/move to a plan term shorter than the original agreed term – i.e. a customer on a 24 month plan may not move to a plan on a 12 month term. Customers who wish to do so will be required to pay all associated exit fees as per Customer Declaration - point 2.
h) Technician fees will in all cases be passed on to customers where investigations (site visits or testing) determine faults or problems that prevent the correct provisioning of an ADSL service. i.e. there is a problem with connections or cabling that are the property of the landlord or tenant.
i) VoIP (Voice over IP) is not included in this ADSL plan pricing.
j) Moving an ADSL connection to another property will require the cancellation of existing account and a new application supplied by the Customer to connect the service to new residence. Cancellation fees will only apply if cancellation occurs within the first 6 months as per section 2. (i) of this agreement. A $119.00 re-connection fee will apply to the new residence. A 6month contract or the remainder of the Customers original contract, whichever is greater, shall apply to the new connection.
k) Phone Disconnection: If the phone number that your ADSL service is attached to is disconnected by your phone carrier due to non-payment or other reason, the ADSL will also be disconnected. A reconnection fee of $119 will apply and standard wait times for reconnection will also apply. A 6-month contract or the remainder of the Customers original contract, whichever is greater, shall apply to the new connection.
l) Account Suspension: Should the ADSL account be suspended due to failure to pay or other reasonable matter, a re-activation fee of $39.00 will apply and be immediately charged to the customer.
m) Early Contract Termination: Where any of the following occurs prior to the expiration of the Minimum Contract Term as selected by the Customer:

a. Customer terminates this Agreement.
b. DragNet terminates this Service of the Agreement due to a breach by Customer;

The Customer agrees to pay DragNet an Early Contract Termination fee as out lined in section 2 of these terms.

2. The Early Contract Termination Charge will be calculated under the following criteria. If cancelling…

a. within the first 6 months = $350.00 - flat rate
b. between 6 to contract term = $350.00 (on a pro-rata basis of months remaining on contract - i.e. a customer with 15 months remaining on a 24 month term will pay $218.75 to exit their contract)

3. ADSL Plans Definitions

a. All plan megabyte allowances are metered as inbound and outbound data traffic.

b. One Gigabyte = 1000 Megabytes.

c. All shaped plans are slowed to 64k/64k download/upload once downloaded allowance is reached. Shaping will continue until the end of the current monthly plan cycle.

d. Shaping of all ADSL plans is voluntary/optional and is charged at the rate of $3.30 per month.

e. ADSL 256/64 Green Light 100MB plan is limited to a 6-month maximum term. Customers on this plan must upgrade to an alternate plan at the conclusion of their 6-month term, or cancel their service. If the customer fails to upgrade their service at this time they will be automatically upgraded to the next plan in the ADSL Residential & Business Schedule.

f. All ADSL Business & Residential plans are calculated and monitored on either a total data, or peak/off-peak data allowance basis.

g. All DragNet plan usage (beyond the basic monthly amount) is charged at the rate of $.10 per MB, once the basic monthly allowance of data has been reached.
